2. OVERVIEW
Beauté Magasin operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated beauty and cosmetics shopping experience (the “Services”). Our store is powered by Shopify.
These terms and conditions, together with our Shipping Policy, Refund Policy and Privacy Policy (collectively, the “Terms”), describe your rights and responsibilities when you use the Services. By visiting, interacting with or using our Services, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
Nothing in these Terms excludes or limits your mandatory statutory rights as a consumer under the laws of the European Union or your country of residence.
3. ELIGIBILITY
By using the Services, you confirm that you are at least 18 years old, or that you use the Services under the supervision of a parent or legal guardian. You agree to provide accurate, current and complete information when placing an order.
4. PRODUCTS AND DESCRIPTIONS
We sell cosmetic and beauty products. We make every effort to describe and display our products accurately, but we do not warrant that product descriptions, colours, images or other content are complete, current or error-free, and actual colours may differ depending on your device’s display.
All products are subject to availability. We reserve the right, at any time and without liability, to limit quantities, discontinue any product, or refuse or cancel any order at our discretion.
Cosmetic products are intended for external use only and must be used in accordance with the instructions and warnings on the packaging. You are responsible for reviewing the ingredients before use if you have known allergies or sensitivities. If irritation occurs, discontinue use. To the extent permitted by law, we are not liable for adverse reactions resulting from misuse or from a failure to follow product instructions.
5. PRICING AND PAYMENT
Prices are shown in euros (EUR) and include VAT where applicable, in accordance with EU law. Prices and offers may change at any time before an order is confirmed.
We reserve the right to correct any errors, inaccuracies or omissions in pricing or product information, and to cancel any order placed on the basis of such an error, even after an order confirmation has been sent. Where an order affected by an obvious error has already been paid, we will refund the amount paid in full.
Payment must be made in full at the time of purchase using the payment methods available at checkout, which include major debit and credit cards and other payment options offered through our checkout provider. By submitting payment details you confirm that you are authorised to use the chosen payment method.
6. ORDERS AND CONTRACT FORMATION
After you place an order, you will receive an order confirmation email acknowledging receipt of your order. This acknowledgement does not constitute acceptance of your order. A binding contract of sale is formed only when we dispatch the products to you.
We may refuse or cancel an order, in whole or in part, including where we suspect fraud or unauthorised payment, where a pricing or description error has occurred, or where products are unavailable. If we cancel a paid order, we will issue a full refund of the affected amount.
7. SHIPPING AND DELIVERY
All orders are dispatched from Spain and shipped via UPS. Dispatch times, delivery estimates and shipping costs are set out in our Shipping Policy, which forms part of these Terms. Delivery times are estimates only and are not guaranteed. Risk of loss or damage to the products passes to you upon delivery, in accordance with applicable consumer law.
8. RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS
If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason, in accordance with EU consumer protection law.
Please note that, for reasons of health protection and hygiene, sealed cosmetic products are not eligible for return once they have been unsealed after delivery. This exception is permitted under EU law and does not affect your rights in respect of products that are defective, damaged or not as described.
The full procedure for exercising your right of withdrawal, together with our returns and refund process, is set out in our Refund Policy, which forms part of these Terms.
9. LEGAL GUARANTEE OF CONFORMITY
As a consumer, you are entitled to the legal guarantee of conformity for the products you purchase, in accordance with EU law. If a product is defective or does not conform to the contract, you are entitled to have it repaired, replaced, reduced in price or refunded, as provided by applicable law. 10. ACCEPTABLE USE
You agree not to use the Services for any unlawful or unauthorised purpose, not to breach any applicable laws, and not to transmit harmful code, interfere with the security or proper functioning of the website, or attempt to gain unauthorised access to our systems or data. We may suspend or terminate your access to the Services if you breach these Terms.
11. INTELLECTUAL PROPERTY
All content on this website, including text, graphics, logos, images, product descriptions, layout and design, is owned by Beauté Magasin or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify or otherwise use any content without our prior written consent.
12. THIRD-PARTY SERVICES
Certain features of the Services rely on third-party providers, including Shopify (store platform), our payment processors and UPS (delivery). We are not responsible for the acts or omissions of these third parties beyond our reasonable control, and their services may be governed by their own terms.
13. WARRANTY DISCLAIMER
To the fullest extent permitted by law, and except as expressly stated in these Terms, the Services and website are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, secure or error-free. This clause does not exclude or limit the legal guarantee of conformity or any other mandatory consumer rights.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Beauté Magasin shall not be liable for any indirect, incidental, special or consequential loss or damage, nor for any loss of profit, data or business, arising out of or in connection with your use of the Services.
Where we are found liable, and зto the extent permitted by law, our total liability shall not exceed the amount you paid for the order giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. This clause does not affect your mandatory statutory rights as a consumer.
15. FORCE MAJEURE
We are not liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, extreme weather, strikes, transport or carrier disruptions, failures of third-party providers, or acts of government or public authorities.
16. PERSONAL DATA
Your submission of personal information through the Services is governed by our Privacy Policy, which explains how we collect, use and protect your personal data in accordance with the General Data Protection Regulation (GDPR).
17. CHANGES TO THESE TERMS
We may update or modify these Terms at any time. Changes take effect once posted on this page with an updated “Last updated” date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms. The version in force at the time of your order applies to that order.
18. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the Republic of Latvia and applicable European Union law, without regard to conflict of law principles. As a consumer, you also benefit from the mandatory protections of the law of your country of residence.

19. SEVERABILITY
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be severed and shall not affect the validity and enforceability of the remaining provisions.
